Garantía Limitada

1- Materiales y mano de obra:

New Era warrants that the Work and System will be free from defects in material for ten (10) years and defects in workmanship for twenty-five (25) years after complete Installation (the “Limited Warranty”). Any claim under the Limited Warranty must be made before its expiration date. The customer will receive standard warranties from major equipment manufacturers.

2- Exclusión de Garantía de Materiales:

LA GARANTÍA LIMITADA ANTERIOR EXCLUIRÁ TODOS LOS PRODUCTOS NO FABRICADOS POR SUNPRISE. EL CLIENTE SERÁ PRIVADO DE CUALQUIER GARANTÍA EXISTENTE DEL FABRICANTE. ESTO INCLUYE TODAS LAS GARANTÍAS PROPORCIONADAS POR LOS FABRICANTES DE LOS COMPONENTES, ACCESORIOS Y EQUIPOS INSTALADOS POR SUNPRISE. ESTOS ARTÍCULOS GENERALMENTE INCLUYEN (PERO NO SE LIMITAN A): PANELES SOLARES, INVERSORES Y/O INTERRUPTORES DE DESCONEXIÓN. SE PUEDEN ENCONTRAR COPIAS ESCRITAS DE DICHAS GARANTÍAS EN LÍNEA EN EL SITIO WEB DEL FABRICANTE. SI NO HAY GARANTÍA DISPONIBLE PARA UN COMPONENTE DEL PRODUCTO Y/O ACCESORIO, SUNPRISE SUSTITUIRÁ UNA GARANTÍA RAZONABLE Y EQUIVALENTE. LA GARANTÍA LIMITADA EXCLUYE CUALQUIER EQUIPO O SERVICIO DE MEDICIÓN O MONITOREO.

3- Otras exclusiones:

SUNPRISE NO SE RESPONSABILIZA POR EL SISTEMA FUERA DE SU USO Y PROPÓSITO INTENCIONADO. EL CLIENTE NO HARÁ RESPONSABLE A SUNPRISE POR DAÑOS DIRECTOS O INDIRECTOS RESULTANTES DE USO IMPROPio, MODIFICACIÓN, ALTERACIÓN, REPARACIÓN, MAL USO, ABUSO, VANDALISMO, DAÑOS POR SERVICIOS PÚBLICOS, INCENDIO, TORMENTA, INUNDACIÓN U OTROS ACTOS FORTUITOS.

4- Reparación y reemplazo:

If Customer discovers a breach under the Limited Warranty, New Era will repair or replace the defective Work. New Era or its subcontractors will complete such repairs or replacements within a reasonable time after receipt of the claim. If a correction cannot be completed despite New Era’s reasonable efforts, the Parties will negotiate an equitable adjustment to the Contract Price. The customer is responsible for any product maintenance and/or repair that is required outside of the specified warranties.

5- Garantía de Penetración del Techo:

New Era warrants that all product-related roof penetrations during system installation will be weathertight for a period of twenty-five (25) years. The roof penetration warranty will be void if work on the roof is performed by the customer, the customer’s contractor/subcontractor/agents, or third parties during the 25-year warranty period. The Roof Penetration Guarantee does not cover:(a) Leaks that occur in areas of the roof of the Property not impacted by the System. (b) Pre-existing and/or underlying failures of the roof of the Property. (c) Foreign objects causing damage to the roof of the property (for example, hail, golf balls, etc.).(d) Insufficient or improper maintenance by Customer, Customer’s contractor/subcontractor or Customer’s agents.

6- Garantía de Conexiones Mecánicas y Ensamblaje:

New Era warrants the System’s assembly and mechanical connections to be free from defects in material for a period of ten (10) years and in workmanship for a period of twenty-five (25) years after complete Installation.

7- Garantía contra daños:

If the damage is caused by a New Era representative at any time during the Work, New Era will repair the damage or reimburse Customer for the damage as limited by the Exceptions and Exclusions below:

8- Excepciones y exclusiones de la garantía de mano de obra. La garantía de mano de obra no se aplica a lo siguiente:

(a) TRABAJOS REALIZADOS O MATERIALES UTILIZADOS POR CUALQUIER PERSONA QUE NO SEA SUNPRISE O SUS REPRESENTANTES. (b) CUALQUIER MATERIAL MODIFICADO, REPARADO O INTENTADO REPAR POR CUALQUIER PERSONA QUE NO SEA SUNPRISE O SUS REPRESENTANTES SIN LA AUTORIZACIÓN PREVIA POR ESCRITO DE SUNPRISE. (c) CUALQUIER DAÑO RESULTANTE DEL INCUMPLIMIENTO DEL CONTRATO POR PARTE DEL CLIENTE. (d) DAÑOS DERIVADOS DEL DESGASTE ORDINARIO. (e) DAÑOS EN LA VIVIENDA DEBIDOS A LA CLIMATIZACIÓN, INCLUIDOS, ENTRE OTROS, EL HIELO O LA NIEVE CAÍDA DEL SISTEMA O LAS CATÁSTROFES NATURALES. (f) DAÑOS DEBIDOS A SUCESOS DE FUERZA MAYOR. (g) DAÑOS DERIVADOS DE MOHO, HONGOS Y OTROS PATÓGENOS ORGÁNICOS. (h) HUNDIMIENTO/RAYADO DE LECHADAS Y MASILLAS. (i) DERRAMES DE PINTURAS Y ACABADOS EXPUESTOS A LA LUZ DEL SOL.EL CLIENTE RECONOCE QUE UNA VEZ FINALIZADA LA INSTALACIÓN, SE LE PODRÁ COBRAR UN CARGO POR CUALQUIER TRABAJO REALIZADO POR SUNPRISE NO CUBIERTO POR LA GARANTÍA. ASIMISMO, EL CLIENTE RECONOCE QUE LA INSTALACIÓN DEL SISTEMA PUEDE ANULAR CUALQUIER GARANTÍA PREEXISTENTE DEL FABRICANTE O INSTALADOR DE LA CUBIERTA. SUNPRISE NO ASUME NINGUNA RESPONSABILIDAD POR LA ANULACIÓN DE CUALQUIER GARANTÍA PREEXISTENTE PARA CUBIERTAS. ANTES DE LA INSTALACIÓN, EL CLIENTE DEBERÁ CONSULTAR CON EL TECHADOR O CONSTRUCTOR SI EL SISTEMA AFECTARÁ A UNA GARANTÍA DE TEJADO EXISTENTE.

9- Incumplimiento de garantía o disputas:

If a dispute arises over a possible breach of warranty, the Parties will mutually agree to tests of the System. Customer and New Era will be notified of any System testing so that each Party may have a representative present.

10- Recurso Exclusivo:

LA GARANTÍA LIMITADA SERÁ EL ÚNICO RECURSO PARA TODOS LOS DEFECTOS DE MATERIAL Y MANO DE OBRA PROVISTOS BAJO ESTE ACUERDO. AL VENCIMIENTO DE LA GARANTÍA LIMITADA, EL CLIENTE ACUERDA Y ENTIENDE QUE LA RESPONSABILIDAD DE SUNPRISE POR EL PRODUCTO TERMINARÁ Y CADUCARÁ AUTOMÁTICAMENTE. EL CLIENTE ENTIENDE QUE ESTO INCLUYE CUALQUIER INCUMPLIMIENTO DE GARANTÍA QUE PUEDA SURGIR DESPUÉS DEL VENCIMIENTO DE LA GARANTÍA.

12- Transferencias de garantía:

All warranties included in this Agreement are intended solely for the original Customer. Under no circumstances will warranties through New Era be transferable to subsequent owners. Customer acknowledges and understands its obligation to inform subsequent owners verbally and in writing that any and all warranties are non-transferable.
